The Dutch Data Protection Authority (“DPA”) is designated as the supervisory authority for the processing of personal data under the General Data Protection Regulation (“GDPR”). In addition, since January 2023, the Dutch DPA started acting as an algorithm regulator. Your organization may also face supervision and/or enforcement in any of these areas. For example, think of reporting and questions in response to a data breach, a complaint from a data subject or an on-site investigation by the Dutch DPA. In addition, you may face the Consumer and Market Authority, which supervises compliance with the Telecommunications Act, including the ban on spam and the use of cookies or similar techniques, and online consumer protection.
